These Terms of Service (the “Terms”) govern your access to and use of our website, programs, and services. By purchasing or using any plan, you agree to these Terms.
1. Eligibility & Accounts
You must be at least 18 years old to use our services. You are responsible for your account and for keeping your login secure.
2. Health & Safety
Exercise involves risks. You agree to consult a physician before starting any program and to stop any activity that causes pain, dizziness, or shortness of breath. Our content is for educational purposes and is not medical advice.
3. Coaching & AI Features
Our services may include AI‑enabled form feedback. Results vary by individual. You are responsible for applying guidance within your personal limits and environment.
4. Payments, Renewals, and Cancellations
Subscription plans bill monthly until canceled. You may cancel at any time; cancellation takes effect at the end of the current billing cycle and we do not issue partial refunds. One‑time purchases (e.g., Intro Month) are charged at checkout.
5. Refunds
Except where stated in a separate Refund Policy or required by law, fees are nonrefundable. If you experience a technical issue that prevents use, contact us within 7 days and we will work with you to resolve it.
6. Acceptable Use
Do not misuse the services, attempt to access others’ accounts, interfere with security, or reverse‑engineer our technology.
7. Intellectual Property
All content, trademarks, and materials are owned by us or our licensors. You receive a limited, non‑transferable license to use the services for personal, non‑commercial fitness purposes.
8. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY LAW.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID IN THE 3 MONTHS BEFORE THE CLAIM AROSE.
10. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to conflict of laws rules. Any dispute will be resolved by binding arbitration in Florida, on an individual basis, and you waive the right to a jury trial and to participate in a class action, to the extent permitted by law.
11. Changes
We may modify these Terms. Continued use after changes means you accept the updated Terms.
